A FEW RECENT EXAMPLES

  • Participation in early neutral evaluation that resulted in the opposing party re-evaluating its position and ultimately agreeing to a “nuisance value” settlement that allowed our client to avoid the risk and expense of litigation.
  • Representation of client in a “Mini Trial” in which both parties presented an abridged argument and summarized evidence to a panel who then successfully negotiated a non-binding “advisory” settlement that both parties agreed to accept.
  • Recommendation and retention of a “Private Judge” to preside over a time sensitive dispute that could not get scheduled for trial on the state court docket before both parties would have suffered the loss of a valuable shipping contract.
  • Representation of client in a multi-day mediation involving six different insurance carriers in which the mediator assisted in strategically exhausting all primary policies in order to trigger coverage by an excess carrier that had refused to participate in settlement.
